Com a tardia revogação da legislação migratória da ditadura militar, a nova Lei de Migração (Lei n.º 13.445, de 24 de maio de 2017) foi apresentada como um trunfo do Brasil em suas Relações Internacionais. Tratar-se-ia, segundo o governo federal da época, de uma legislação moderna, que amplia direitos e desburocratiza exigências para o ingresso e a permanência no Brasil. Voltada ao estudo da regulamentação da nova lei, a presente tese demonstra as contradições entre o texto legal e a regulamentação que a ele se seguiu, em especial o Decreto n.º 9.199/2017. Para tanto, examina o regime jurídico das migrações em vigor no ordenamento jurídico brasileiro, mapeando os dispositivos que obstaculizam e/ou comprometem a implementação da norma vigente. Conclui que houve abuso da função regulamentar por parte do Poder Executivo, ensejando grande potencial de violação dos direitos humanos dos migrantes em território nacional.

With the late repeal of the migratory legislation from the military dictatorship period, the new Migration Law (Law n.º 13.445, May 24th, 2017) was presented as a trump card of Brazil in its International Relations. According to the federal government at the time, this would be a modern legislation that broadens rights and reduces bureaucracy for the entry and the residence in Brazil. Aimed at studying the regulation of the new law, this thesis demonstrates the contradictions between the legal text and the regulation that followed it, in particular Decree n.º 9.199/2017. To this end, it examines the current regime for migrations in Brazilian's legal system, mapping the devices that hinder and/or compromise the implementation of the present norm. It concludes that there was abuse of the regulatory function by the government, resulting in a great potential of violation of human rights of migrants in the national territory.
