Neste trabalho investigamos o espaço que emoções, sentimentos e moralidades ocupam no julgamento para a punição de um crime. Selecionamos o remorso como categoria de análise, dada a importância que ele detém no ambiente jurídico. A fim de atingir o objetivo de explorar o conceito de remorso como uma emoção moral e examinar sua relação com o direito, empregamos a revisão bibliográfica sistemática como método de coleta de dados, os quais utilizamos para responder à pergunta de pesquisa: O que sabemos sobre remorso no contexto jurídico? Da pesquisa realizada, selecionamos 83 artigos sobre o tema e distribuímos eles em 11 categorias de revisão definidas por assunto. Analisamos esses dados a partir de referências a conceitos sobre crime, sanção e racionalidade jurídica; punição; teoria da emoção construída; e remorso em contexto jurídico. A organização dos dados em mapas bibliográficos nos permitiu definir o contexto atual das pesquisas publicadas com o tema remorso, bem como traçar um panorama para pesquisas futuras que relacionem esse tema a outras variáveis presentes na sociedade, como: remorso e questões cognitivas; remorso e questões patológicas; remorso e questões ambientais, entre outros.

In this study, we explore/investigate the role of emotions, feelings, and moral considerations in the trial process in order to determine punishment in criminal cases. We have chosen remorse as a focal category for analysis, recognizing its significance within the legal environment. To delve into the concept of remorse as a moral emotion and its correlation with criminal law, we employed/conducted a systematic literature review as our data collection approach, aiming to address the research question: What do we know about remorse in terms of/based on/in the legal context? Based on/upon our conducted research, we selected 83 articles related to the topic and categorized them into 11 review categories based on subject matter. We analyzed/examined this dataset focusing on references to concepts related to/such as crime, sanctions, and legal rationality; punishment; constructed emotion theory; and remorse in the legal context. The organization/ the arrangement of data into bibliographic maps allowed us/ enabled us to define/establish the present landscape of research concerning the topic of remorse and provided a framework for future studies linking this topic with various societal variables, including remorse and cognitive factors; remorse and pathological conditions; remorse and environmental considerations, among others.
