A presente pesquisa tem como objetivo demonstrar como o poder judiciário vem lidando com a questão do uso do uniforme da unidade prisional pelo acusado preso em seu julgamento perante o Tribunal do Júri, considerando que ele é visto como diferente e, portanto, pode influenciar na decisão dos jurados. Considera, ainda, que a vestimenta é uma escolha do réu, bem como uma estratégia de defesa. Foram realizadas pesquisas bibliográficas para entender qual o papel social da vestimenta na sociedade e para desbravar os símbolos, rituais e formalidades da área jurídica que faz com que o diferente, naquele ambiente, seja visto com outros olhos. A pesquisa avançou ainda para entender como funciona o ritual do Tribunal do Júri, com o intuito de demonstrar que o evento jurídico, cheio de regras e formalidades, destaca, ainda mais, o estigma de culpa que existe no uniforme carcerário e aquele que se apresente de maneira diferente. Foram realizadas, ainda, pesquisas documentais em acórdãos, de habeas corpus e recursos de apelação, com o objetivo de demonstrar que o assunto é discutido no meio jurídico. Os resultados demonstram que, são realizados pedidos para a troca de vestimenta do réu preso antes da sessão do Júri e que ainda não há uma unanimidade quanto à autorização ou entendimento de que a indumentária possa exercer influência sobre os acusados. Por sua vez, os pedidos de nulidade do Júri pelo acusado se apresentar utilizando o uniforme da unidade prisional, majoritariamente, são negados, principalmente em razão da ausência normativa sobre o tema, apesar de existir recomendações do STJ.

The present research aims to demonstrate how the judiciary has been dealing with the issue of the use of the prison unit uniform by the arrested accused in his trial before the Jury, considering that he is seen as different and, therefore, can influence the decision. of the jurors.It also considers that clothing is a choice made by the defendant, as well as a defense strategy. Bibliographical research was carried out in order to understand the social role of clothing in society and to explore the symbols, rituals and formalities in the legal area that make what is different, in that environment, be seen with different eyes. The research also advanced to understand how the Jury Court ritual works, with the aim of demonstrating that the legal event, full of rules and formalities, highlights, even more, the stigma of guilt that exists in the prison uniform and those who present themselves in a different way. Documentary research was also carried out on rulings, habeas corpus and appeals, with the purpose of demonstrating that the subject is discussed in the legal environment. The results demonstrate that requests are made to change the clothing of the arrested defendant before the Jury session and that there is still no unanimity regarding the authorization or understanding that the clothing may exert influence on the jurors. In turn, the Jury's requests for nullity due to the accused appearing wearing the prison unit's uniform are mostly denied, mainly due to the lack of regulations on the subject, despite there being recommendations from the STJ.
