O trabalho investiga a possibilidade do reconhecimento jurídico de vínculos de família extensa formados a partir da afetividade. Para isso, parte das discussões provocadas pelo romance O filho de mil homens, de Valter Hugo Mãe, que narra a formação de uma família por laços de afetividade que se expressam não somente em relações de conjugalidade e parentalidade, mas também em outros níveis de parentesco, constituídos entre diferentes personagens que desempenham papeis fundamentais na estrutura familiar. A partir dessa reflexão, foi realizada pesquisa bibliográfica analisando a natureza jurídica da afetividade, para que se pudesse compreender a sua influência sobre o sistema jurídico e a sua autonomia na formação de vínculos de parentesco. Além disso, foi desenvolvida pesquisa jurisprudencial com a finalidade de rastrear o entendimento recente do Judiciário brasileiro em demandas promovidas por membros de família extensa afetiva em busca da incidência de algum efeito decorrente dessa relação familiar. Por fim, foram levantadas algumas reflexões sobre as perspectivas do reconhecimento dos vínculos de família extensa afetiva no Direito contemporâneo, com destaque especial às discussões a respeito do instituto da senexão, que pretende regulamentar a colocação de pessoas idosas em famílias substitutas na condição de "parentes atípicos". O trabalho conclui pela possibilidade e relevância do reconhecimento jurídico dos vínculos de família extensa formados pela afetividade, de forma a atribuir-lhes todos os efeitos decorrentes das relações familiares, com vistas à autorrealização e ao melhor desenvolvimento de cada um dos seus membros.

This dissertation investigates the possibility of legal recognition of extended family bonds formed from affectivity. The research starts from the discussions raised by the novel O filho de mil homens, by Valter Hugo Mãe, which narrates the formation of a family through affective bonds that are expressed not only in conjugal and parenting relationships, but also in other kinship levels, formed between different characters that play fundamental roles in the family structure. Then, a bibliographic research was carried out to analyze the legal nature of affectivity, in order to understand its influence on the legal system and its autonomy in the formation of kinship ties. In addition, there was jurisprudential research to trace the recent understanding of Brazilian Judiciary in lawsuits filed by members of an extended affective family in search of some legal effect. Finally, some reflections were raised about the recognition of affective extended family ties in contemporary law, with special emphasis on discussions about the institute of senexão, which intends to regulate the placement of elderly people in substitute families in the condition of atypical relatives. The dissertation concludes by the possibility and the relevance of legal recognition of extended family ties formed by affectivity, granting them the legal effects of family bonds, with the purpose of self-realization and the better development of each of its members.
