Esta dissertação investigou a eficácia da Recomendação de n. 62 do CNJ nas câmaras criminais do Tribunal de Justiça de São Paulo, durante a primeira onda pandêmica causada pela Covid-19. Inicialmente, percebeu-se que o coronavírus se instalou sobre uma sociedade desigual, composta por grupos vulneráveis, dando ênfase especial à população carcerária.Partiu-se do marco teórico do estado de coisas inconstitucional assinalado pelo SupremoTribunal Federal em 2015. Lado outro, estabeleceu-se a Recomendação de n. 62 do CNJ como uma política criminal importante no enfrentamento à crise pandêmica. Neste sentido, analisou-se a (in)aplicabilidade deste documento pelo tribunal paulista, realizando, também, através do método de análise de conteúdo, a categorização dos fundamentos utilizados pelos magistrados, visando compreender a racionalidade das decisões. Posteriormente,compreendeu-se as categorias descobertas por meio da produção acadêmica de Eugênio Zaffaroni, tendo, por fim, realizado um diálogo entre a crise pandêmica no sistema prisional com o conceito de Necropolítica de Achille Mbembe à luz dos elementos empíricos e teóricos colhidos.

This dissertation investigated the effectiveness of The Recommendation of N. 62 of the CNJ in the criminal chambers of the Court of Justice of São Paulo, during the first pandemic wave caused by Covid-19. Initially, it was noticed that the coronavirus settled on an unequal society, composed of vulnerable groups, giving special emphasis to the prison population. It is based on the theoretical framework of the unconstitutional state of things marked by the Supreme Court in 2015. On the other hand, the Recommendation of n.62 of the CNJ was established as an im-portant criminal policy in the face of the pandemic crisis. In this sense, we analyzed the (in)applicability of this document by the São Paulo court, also performing,through the method of content analysis, the categorization of the grounds used by the magistrates, aiming to understand the rationality of decisions. Subsequently, the categories discovered through the academic production of Eugênio Zaffaroni were understood, having,finally, in the light of the empirical and theoretical elements collected, a dialogue between the pandemic crisis in the prison system with the concept of Necropolitics of Achille Mbembe was carried out.
