Esta pesquisa versa sobre o papel do conforto ambiental nas legislações urbanísticas da cidade de São Paulo, principalmente no que se refere às questões ambientais de vizinhança e ao desempenho térmico e luminoso dos edifícios residenciais, destacando-se o papel da legislação como instrumento fomentador da qualidade ambiental urbana. Além da sistematização de dados levantados na legislação de diferentes cidades do mundo e nos resultados de simulações computacionais, busca-se a formulação de argumentos para análise crítica sobre a existência ou a falta da definição de aspectos técnicos e construtivos relacionados ao conforto térmico, luminoso e à eficiência energética, concentrando a investigação no Código de Obras e Edificações paulistano. Com o intuito de se propor algumas melhorias que poderiam ser feitas no Código de Obra e Edificações vigente na cidade de São Paulo, foram realizadas simulações computacionais no modelo TAS/EDSL, para estudos de conforto térmico e luminoso em apartamento típico do mercado imobiliário atual. O método, pelo exposto acima, é indutivo, por meio de estudos analíticos de diferentes legislações urbanísticas e de simulações computacionais de desempenho térmico e luminoso de edifícios residenciais na cidade de São Paulo, e dedutivo, por meio de comparações entre os resultados encontrados de melhor desempenho ambiental, obtidos com estudos paramétricos das variáveis de interesse para o trabalho. A pesquisa é finalizada com a compilação dos resultados obtidos a partir das estratégias de investigação aplicadas, reforçando as considerações levantadas sobre as necessidades de se discutir e rever, com urgência, a legislação da cidade de São Paulo, alinhando-a à demanda global por instrumentos regulatórios que busquem a eficiência energética, o desempenho adequado do espaço edificado e a resiliência urbana para um futuro de desafios colocados pelas mudanças no clima. Apresentam-se, ao final, duas sugestões para revisão do código: a primeira delas seria um caminho ideal e transformador, capaz de incluir diretrizes baseadas no desempenho dos edifícios e, a segunda seria um caminho mais viável a curto prazo, devolvendo à lei seus parâmetros prescritivos, mas com indicadores atualizados, perdidos ao longo das sucessivas revisões, dentre os quais itens básicos como a utilização de aspectos climáticos para orientação solar de aberturas dentre as diretrizes para implantação de edifícios, que hoje nem sequer são mencionados.

This research deals with the role of comfort in the urban regulations of São Paulo city, especially concerning neighborhood issues and thermal and daylight performance of residential buildings, highlighting the role of urban legislation as a promoting tool for environmental quality. In addition to the systematization of data collected in the urban legislation of different cities of the world and the results of numerical simulation, this research seeks the formulation of arguments for critical analysis on the existence of lacks on technical and constructive aspects related to thermal comfort, daylight and energy efficiency concentrating the research in the São Paulo Building Code. To propose some improvements in the Building Code in force in São Paulo, simulations were carried out in the TAS / EDSL model, for a typical residential apartment. The method is inductive, by means of analytical studies and simulation of thermal and daylight performance of residential buildings in the city of São Paulo, and deductive, through comparisons between the results found among different results of better environmental performance, obtained with parametric studies of the variables involved. To conclude, a compilation of the results obtained from the applied research strategies is presented, reinforcing some considerations raised on the need to discuss and revise the urban regulation of São Paulo city. The need to align the laws with the global demand for regulatory instruments that seek energy efficiency, adequate performance of built space and urban resilience for a future of challenges posed by climate change is more than urgent. At the end, two suggestions for reviewing the code are presented: the first is an ideal and transformative way, capable of including guidelines based on the performance of buildings; the second is a more viable path, short-term, which would require returning to the law some prescriptive parameters, based on updated benchmarks, lost during the code's successive versions, among which are the climatic aspects relating to the solar orientation for the implementation of buildings, which today are not even mentioned.
