O presente trabalho tem por objetivo realizar estudo acadêmico sobre o contrato built to suit, em especial quando firmado entre sociedades empresárias. Ao longo da dissertação, procuramos investigar a natureza jurídica e algumas classificações desse modelo contratual, em especial sua caracterização como contrato atípico. A considerar a atipicidade contratual, realizamos análise da disciplina jurídica e o confronto necessário com a Lei do Inquilinato (alterado pela Lei 12.744/2012). Também procuramos investigar problemas práticos decorrentes do contrato built to suit tais como registro imobiliário e securitização dos recebíveis. Ao final, foi realizado estudo a respeito das consequências jurídicas advindas da extinção do contrato built to suit.

The object of this study is the academic analysis of built to suit agreements, especially when executed between companies. Throughout the dissertation, we tried to investigate the legal nature and some classifications of this contract type, specially its characterization as an unregulated agreement. Considering such contractual atypicality, we analyzed its legal discipline and the necessary confrontation with the Law of Tenancy (modified by Law 12.744/2012). We investigated practical problems arising from the contract built to suit, such as real estate registration and securitization of receivables. In the end, a study was carried out regarding the legal consequences arising from the termination of the contract built to suit.
