Os impactos negativos decorrentes da corrupção e da improbidade administrativa ultrapassam os danos infligidos aos bens do respectivo ente público. Além dos danos eventualmente causados ao erário e aos demais bens pertencentes à pessoa jurídica de direito público, é inegável o consequente rebaixamento da qualidade de vida em geral da sociedade vítima direta e indireta dos desmandos praticados por agentes públicos corruptos e eventuais particulares partícipes. Impõe-se, nesse cenário, o estudo do dano social advindo de corrupção e de improbidade administrativa, para que a responsabilidade civil não focalize apenas a reparação dos danos causados, v.g., ao erário, mas também objetive a restauração da qualidade de vida da população afetada. Ademais, a vivência prática demonstra que, em razão de diversos motivos, 1 as investigações referentes à corrupção e à improbidade administrativa geralmente se protraem no tempo, assim como o processamento das ações correlatas. Nesse sentido, o estudo em apreço possui a finalidade de analisar o respectivo regime jurídico de responsabilidade civil, apreciando também questões análogas, como os acordos de não persecução, o alcance do artigo 37, § 5º, da Constituição Federal, considerando a decisão proferida pelo Supremo Tribunal Federal no recurso extraordinário n. 852.475, entre outras. Ausentes esse enfoque específico de sua dimensão técnico-jurídica e respectiva abrangência metodológica, deixa-se de reparar a totalidade dos danos causados, em notório prejuízo da população e do Estado Democrático de Direito, o que, de modo inexorável, favorece indevidamente o autor do ilícito. Assim, percebe-se que, além dos danos ordinariamente apurados e reprimidos, os atos de corrupção e de improbidade administrativa causam dano social, que necessita ser objeto de estudo próprio para sua devida reparação. Apenas dessa forma todos os seus consectários negativos podem ser corretamente prevenidos e reprimidos, evitando-se novos ilícitos contra a já aviltada sociedade.

The negative impacts resulting from corruption and administrative improbity outweigh the damage inflicted on the assets of the respective public entity. In addition to the eventual damage caused to the treasury and other assets belonging to public legal entities, the consequent decrease in the quality of life in general for society is undeniable direct and indirect victim of the misdeeds practiced by corrupt public agents and occasional participating homes. In this scenario, the study of social damage arising from corruption and administrative immobility is imperative, so that civil liability does not focus only on repairing the damage caused, e.g., to the treasury, but also aims at restoring the quality of life of the affected population. In addition, practical experience shows that, due to various reasons,2 investigations regarding corruption and administrative improbity usually protrude over time, as well as the processing of related actions. In this sense, the present study has the purpose of analyzing the respective legal regime of civil liability, also appreciating similar issues, such as non-prosecution agreements, the scope of article 37, § 5, of the Federal Constitution, considering the decision issued by the Federal Supreme Court in extraordinary appeal n. 852,475, among others. Absent this specific focus of its technical-legal dimension and respective methodological scope, it fails to repair the totality of the damages caused, in a notorious prejudice to the population and the Democratic State of Law, which, inexorably, favors unduly the perpetrator of the offense. Thus, it is clear that, in addition to the damage that is ordinarily determined and repressed, acts of corruption and administrative improbity cause social damage, which needs to be the object of a proper study for its due repair. Only in this way can all its negative consequences be correctly prevented and repressed, avoiding new illicit acts against the already debased society.
