O tema desta tese é a denominada exceção de contrato não cumprido (exceptio non adimpleti contractus), antigo remédio contratual aceito em países de tradição romano-germânica, mas pouco explorado pela doutrina brasileira, que apenas recentemente voltou a dedicar-se ao seu estudo. Considerando os recentes estudos sobre a exceção de contrato não cumprido, pretende- se analisar sua natureza jurídica, suas raízes históricas (trata-se de remédio formulado pelos canonistas e desenvolvido pela doutrina medieval, embora o gênero exceção derive do direito romano), seu campo de incidência no Direito brasileiro e, em especial, sua função de autotutela contratual ou, mais rigorosamente, de verdadeira sanção privada. Com base nesses pressupostos, e em seu confronto com o sistema brasileiro de remédios contratuais, busca-se formular uma proposta de incidência da exceção de contrato não cumprido que seja mais restritiva, i.e., não se aplicando aos deveres derivados da boa-fé. Por fim, será analisado brevemente o comportamento desse remédio de autotutela nos contratos administrativos buscando, na interpretação sistêmica, mais um argumento que sustente a presente proposta de incidência restritiva.

This thesis addresses the exceptio non adimpleti contractus, a legal remedy which ensures that, in a reciprocal contract, a party may withhold their performance until the other party has duly performed their obligations. For a long period of time, this remedy has been ordinarily exercised in civil law jurisdictions, but it was not until recently that Brazilian scholars began to periodically research about the theme. Based on these recent studies, the thesis shall analyzes the legal framework of exceptio non adimpleti contractus, while also looking over its historical roots as a remedy established under Canon Law and developed by scholars in the Middle Ages, albeit derived from civil law tradition. In sequence, we proceed to establish the grounds for its exercise under Brazilian law and its role of being a self-help mechanism, specifically as a penalty that shall be implemented by the non-breaching party. In this sense, the exceptio will be studied vis-à-vis the set of legal remedies in Brazilian Contract Law and we shall advocate a more restrictive application of the exceptio, i.e., not applicable to the duties derived from good faith doctrine. Finally, the behavior of this self-help mechanism in contracts involving the public administration will be briefly analyzed seeking, into systemic interpretation, one more argument that supports the present proposal of restrictive incidence.
