Este trabalho trata-se de uma pesquisa feita por meio da abordagem dedutivo-dialética com a finalidade de conceituar e analisar o mercado da moda para esclarecer como os direitos intelectuais podem ser violados nesta esfera e, portanto, descobrir qual a melhor forma de proteção a ser aplicada pelos agentes econômicos deste mercado sem prejudicar a inovação em relação às marcas e aos direitos de exclusividade no mundo globalizado. As criações de moda podem ser protegidas tanto pela Propriedade Industrial quanto pelo Direito Autoral. O tipo de proteção deve ser escolhido de acordo com as características da criação e da perenidade que o criador pretende dar à obra. Cópias fazem parte da indústria e impulsionam a inovação até certo ponto ao passo que, em determinado grau, tornam-se nocivas ao mercado e prejudicam não somente os criadores, mas também toda a sociedade. Foi analisado como o nível de proteção regula os investimentos do mercado. Também foram estudados os direitos de exclusividade pelo enfoque dos direitos autorais e da Propriedade Industrial, bem como as vantagens e desvantagens da adesão do Brasil ao Protocolo de Madrid, com análise de casos envolvendo marcas estrangeiras no país e marcas brasileiras no exterior.

This work is a research done through the deductive-dialectical approach with the purpose of conceptualizing and analyzing the fashion market to clarify how intellectual property rights can be violated and, therefore, discover the best form of protection to be applied by the players of this market without harming innovation, in relation to brands and exclusivity rights in the globalized world. Fashion creations in Brazil can be protected by both Trademark and Copyright. The type of protection must be chosen according to the characteristics of the creation and the perpetuity that the creator intends. Copies are part of the fashion industry and drive innovation to a certain extent, while to a certain degree they become harmful to the market and harm not only the creators but also the whole society. It will be analyzed how the level of protection regulates market investments. Exclusivity rights will also be studied from the perspective of copyright and Trademark, as well as the advantages and disadvantages of Brazil's accession to the Madrid Protocol, with an analysis of cases involving foreign brands in the country and Brazilian brands abroad.
