A história do processo de codificação civil no Brasil, ao longo do século XIX, é comumente contada como uma fábula jurídica frustrada. Mal sistematizado e pouco completo, o processo aparece nas narrativas históricas como sucessões de insucessos, não obstante uma série de esforços descomunais de eminentes juristas que, com seus projetos brilhantes, não encontraram espaço para reconhecimento de seus trabalhos visionários em um contexto de pouca ilustração no qual se encontrava o Brasil. Esta visão, tanto tendenciosa e protecionista de uma classe jurídica, revela pouco sobre o quê o processo de elaboração, ou não elaboração, de um código civil brasileiro, ao longo de todo século XIX e início do XX, pode trazer de contribuição para a compreensão de aspectos fundamentais da construção do Estado brasileiro. Em contraponto a tal visão, apresenta-se a proposta de investigar a trajetória do Código Civil Brasileiro através de uma perspectiva da Codificação como uma tarefa estatal. Em outras palavras, recontar a história da codificação civil do ponto de vista de elementos da estatalidade, ou seja, dentro de uma perspectiva de análise que tenta ler uma suposta agenda estatal de prioridades legislativas (procedimento legislativo). Isto porque a prática legislativa está sempre inserida em contextos que acabaram por ditar os resultados de cada empreendimento estatal para a realização da codificação civil. Este, aliás, é o ponto central da pesquisa do presente trabalho. A investigação do processo de formação desta estrutura jurídica no Brasil representada pelo Código Civil será realizada através da análise histórica, e dentro do lapso temporal que é o séc. XIX, observando como foi forjado no Brasil um novo modelo de Direito: o Direito Moderno, marcado por uma estrutura organizativa (ou ordem) que se caracteriza principalmente pela existência de um corpo de leis organizadas em Códigos e em Constituições escritas. A partir do estudo da relação de como se deu no Brasil o processo de formação desta estrutura nova ordem jurídica e os contextos políticos de sua elaboração, parte-se para a análise do sentido e objetivo que se tinha em estruturar o direito desta determinada forma, ou seja, do projeto jurídico brasileiro. Projeto capaz de garantir a consolidação de certa ordem, calcada em interesses claros (mas nem sempre desvelados): a ordem econômica liberal.

The civil codification process history in Brazil during the nineteenth century is commonly told as a frustrated legal fable. Badly systematized and incomplete, the process appears in historical narratives as a succession of failures despite a series of monstrous efforts of eminent jurists who, with their brilliant designs, found no space for recognition of their visionary works in the little cut context in which Brazil was. This view, both biased and protective of a legal class, reveals little about the process of drafting, or not drafting, of a Brazilian civil code, throughout the nineteenth and early twentieth centuries, can bring as contribution to the understanding of fundamental aspects of building the State in Brazil. Opposing this view, there is a proposal to investigate the trajectory of Brazils Civil Code by seeing Codification as a state task. In other words, retelling the history of civil codification in terms of states elements, i.e., within a perspective of analysis that tries to read a supposed state agenda of legislative priorities (legislative procedure). This is because the legislative practice is always embedded in contexts which ultimately dictate the outcome of each state enterprise to carry out the civil code. This, incidentally, is the focus of this research. The investigation of the legal structure formation process in Brazil represented by the Civil Code will be accomplished through historical analysis, and within the time gap which is the XIX century, noting how it was forged in Brazil a new model of law: the Modern Law, marked by an organizational structure (or order) which is characterized mainly by the existence of a body of laws organized into codes and written Constitutions. From the relation study of how this structure new legal order - formation process happened in Brazil and the political contexts of its development, it starts analyzing the meaning and purpose that existed to structure the law in this particular way, i.e., the legal project in Brazil. Project capable of consolidating certain order, based on clear interests (but not always unveiled): the liberal economic order.
