A presente tese de doutorado tem o objetivo de apontar as relações da norma de zoneamento de São Paulo de 1972 - Lei nº 7.805/72 - com o contexto político e econômico nacional do país no período. Revisitando o surgimento do instrumento em Frankfurt e passando pela produção normativa do zoneamento nos Estados Unidos, a norma de São Paulo é analisada aqui sob a perspectiva do direito econômico. O método escolhido tem o condão de superar os limites da dogmática jurídica sobre o instrumento, dimensionando assim a complexidade sócio-econômica que cria a demanda pela regulação do uso e ocupação do solo de uma cidade. Buscando compreender as condições sócio-econômicas que garantem a produção da lei de zoneamento além do nível entre indivíduos, esta tese também procura identificar quais são as consequências sociais da norma, tentando em alguma medida transpor tais consequências ao objeto aqui estudado. Não só, leva em conta as peculiaridades da posição do Brasil nas relações econômicas internacionais para identificar quais são as condições nacionais que influenciam na produção da norma de zoneamento.

The aim of this thesis is to indicate the relationship between the São Paulo's Zoning Act of 1972 - Law n. 7.805 - and the Brazilian economical and political context of that period. Revisiting the emergence of the zoning legislation in Frankfurt and passing through the normative production of the United States, São Paulo's Act is analyzed under the perspective of the economic law. The chosen method intents to overcome the limits of the traditional Legal doctrine about the instrument, giving a more comprehensive dimension of the socialeconomic complexity that creates the demand for a city zoning regulation. Seeking to understand those socio-economic conditions that ensure the creation of the zoning instrument beyond the individual level, this thesis also tries to identify what are the social consequences of the zoning regulation, applying those consequences to the present object of study. Moreover, it takes into account the peculiarities of Brazil's economical position to identify what are the national conditions that influenced the production of São Paulo's zoning regulation.
