O presente trabalho tem como objetivo analisar se os atuais critérios estabelecidos pela legislação eleitoral no Brasil, para a distribuição dos recursos financeiros diretos e indiretos, mais precisamente do Fundo Partidário e do direito de antena (tempo de rádio e TV) para os partidos políticos no país, representam a opção procedimental mais adequada ao ambiente democrático, especialmente quando analisada sob a ótica do exercício da oposição na política. Para situar o tema de forma adequada, exploram-se inicialmente o conceito de democracia pelos partidos e o papel essencial que as agremiações políticas desempenham no regime, como responsáveis pela condução da representação política, o que demanda investigar como se deu esse processo histórico de reconhecimento de sua importância, mas também as causas patológicas que são inerentes ao fenômeno partidário. Posteriormente, de modo a aprofundar o estudo, analisa-se o contexto de desenvolvimento histórico das legendas partidárias no Brasil, desde a sua configuração como meras facções e o seu desenrolar durante as Repúblicas, investigando período a período como seu deu a construção do processo de formação política no país, mas sobretudo os fatos sociais, políticos e normativos que marcam esse processo evolutivo até a normatização mais recente. Posteriormente, o estudo se debruça sobre o papel do dinheiro e dos recursos financeiros diretos e indiretos na política, como vetor inafastável da manutenção do ambiente democrático, investigando nesse ponto as principais causas que podem impactar negativamente na competição eleitoral, pressuposto este que permite avançar, por conseguinte, na análise do microssistema normativo existente na legislação eleitoral brasileira e que prevê os princípios e as bases de funcionamento de um processo eleitoral competitivo, regulado e sujeito a controle, de modo a garantir a igualdade na competição. Ainda, debruça-se a pesquisa sobre as regras atinentes ao regime misto de financiamento acolhido pelo Brasil, as regras acolhidas pelo ordenamento para distribuição dos recursos financeiros e as espécies de financiamento admitidas na competição política brasileira. Ainda que não pretenda estabelecer uma relação causal direta e imediata entre a distribuição de recursos financeiros como único fator de sucesso nas campanhas eleitorais, a pesquisa faz um levantamento de dados colhidos desde 1998 até 2022, dados estes que envolvem tanto a distribuição dos recursos financeiros diretos e indiretos distribuídos aos partidos políticos brasileiros, como do resultado das eleições para o Poder Legislativo nos mesmos períodos, buscando demonstrar, mesmo que de forma reflexa, os impactos do dinheiro na política e na cooptação do poder político. Ao final, após apresentar os caracteres essenciais que delimitam a oposição na política como fenômeno inafastável dos regimes democráticos, estudam-se os impactos da fixação de cláusulas de barreira ou desempenho no país e da distribuição dos recursos financeiros, para, de forma novidadeira, propor novos critérios de distribuição do Fundo Partidário e do direito de antena.

This thesis aims to analyze whether the current criteria established by the Brazilian electoral legislation for the distribution of direct and indirect financial resources, more precisely the Party Fund and the right to broadcasting time (radio and TV time) for political parties in Brazil, rep- resents the procedural option most suited to the democratic environment, especially when ana- lyzed from the perspective of exercising opposition in politics. To deal with the theme ade- quately, it initially explores the concept of party democracy and the essential role that political associations play in the regime as responsible for conducting the political representation, which requires investigating how this historical process of recognizing its importance is carried out, moreover the pathological causes that are characteristic of the partisan phenomenon. Subse- quently, to deepen the study, it analyzes the context of the historical development of party leg- ends in Brazil, from their configuration as simple factions and their development during the Republics, investigating period by period how the construction of the political formation pro- cess took place in the country, especially the social, political and regulatory facts that leave a mark on this evolutionary process up to the most recent regulation. Subsequently, the study develops on the role of money and direct and indirect financial resources in politics, as a per- manent vector for maintaining the democratic environment, investigating in this point the main causes that can negatively impact on the electoral competition, a precondition which conse- quently allows us to advance in the analysis of the regulatory microsystem existing in the Bra- zilian electoral legislation and which provides the principles and operational bases of a com- petitive electoral process, regulated and subject to control, to guarantee equality on the compe- tition. In addition, the research is based on the rules relating to the mixed regime accepted by Brazil, the rules accepted by the legal system for the distribution of financial resources, and the types of financing admitted in the Brazilian political competition. Although it does not intend to establish a direct and immediate causal relationship between the distribution of financial resources as the only success factor in electoral campaigns, the research reveals data collected from 1998 to 2022, which involves both the distribution of direct and indirect financial re- sources distributed to Brazilian political parties, as well as the results of the elections for the Legislative Branch in the same periods, trying to demonstrate, albeit involuntarily, the impact of money in politics and the co-optation of political power. Finally, after presenting the essential characteristics that delimit the opposition in politics as a permanent phenomenon of democratic regimes, it studies the impacts of setting barriers and/or performance clauses in the country and of the distribution of financial resources, so that, innovatively, proposes new distribution crite- ria for the Party Fund and the right to airtime.
