O objeto do presente trabalho é o estudo da relação entre o sistema jurisdicional difuso de controle de constitucionalidade adotado no Brasil e a base romano-germânica sobre a qual se funda, essencialmente, nosso ordenamento jurídico. A combinação ocorrida no sistema jurídico brasileiro resultou em diversos inconvenientes, que impedem se alcance a isonomia e a segurança jurídica na prestação jurisdicional. A ausência do elemento do stare decisis, que confere coerência ao sistema difuso nos países de common law, fez com que se proliferasse a divergência jurisprudencial de forma descontrolada no Brasil. Colocase, então, o objeto deste trabalho, que é o estudo da relação entre o civil law e o controle difuso de constitucionalidade no Brasil, as consequências que daí advêm e a evolução exigida de nosso sistema de controle para responder aos atritos gerados por essa conjugação.

The purpose of this essay is to study the interactions between the dispersed system of judicial review adopted in Brazil and the civil law tradition on which our legal order is based. The combination occurred in the Brazilian legal system resulted in several inconveniences, which prevent the achievement of isonomy and legal certainty in jurisdictional rendering. The absence of the element of stare decisis, which confers coherence to the dispersed judicial review system in common law countries, has led to jurisprudential divergence in uncontrolled levels in Brazil. The object of this study, therefore, consists on the interactions between the civil law tradition and the dispersed judicial review in Brazil, the consequences of this arrangement and the evolution required of our legal order, to respond to the difficulties generated by this conjugation.
