A presente dissertação objetiva analisar o papel da jurisprudência como fonte do Direito Internacional na Corte Internacional de Justiça, a despeito da adjetivação de fonte subsidiária do Direito Internacional, conforme insculpido no artigo 38 da Estatuto da Corte Internacional de Justiça. A temática está relacionada com a estruturação e funcionamento da solução pacífica de controvérsias internacionais pela via judicial, na busca da paz pelo direito, sob o pálio da justiça. A metodologia da escolha e da análise dos casos será precedida por um estudo exploratório da doutrina sobre a jurisprudência na Teoria Geral do Direito e no Direito Internacional Público. Ante a singularidade do ordenamento jurídico internacional, na qual inexiste um poder legislativo central, num primeiro momento, busca-se articular diversas teorias que explicam a jurisprudência como fonte em sentido estrito, com viés de exercício de jurisdição, para, num segundo momento, compreendê-la como fonte do Direito Internacional na Corte Internacional de Justiça, na consolidação e na construção do corpus juris internacional.

This dissertation aims to analyse the role of the judicial decisions as a source of International Law in the International Court of Justice, in spite of being called subsidiary source of International Law, as inscribed in article 38 of the Statute of International Court of Justice. The theme is related to the structuring and functioning of the peaceful solution of international controversies by judicial means, in the search for peace by Law, under the pallium of justice. The methodology of choice and case analysis will be preceded by an exploratory study of the doctrine on judicial decisions in the General Theory of Law and Public International Law. In the face of the uniqueness of the international legal order, in which there is no central legislative power, at first, we seek to articulate several theories that explain the jurisprudentia as a source in a strict sense, with the exercise bias of jurisdiction, to, in the second moment, understand it as a source of international law in the International Court of Justice, consolidation and construction of corpus juris International.
