A legislação migratória brasileira e as políticas nacionais por ela moldadas foram concebidas, ao longo do século XX, sob a ótica securitária. Tal lógica operacional considerava os migrantes como ameaça à soberania nacional, dispensando aos mesmos tratamentos discriminatórios, marcados pelo reconhecimento seletivo de direitos e operacionalizados através de grande poder discricionário do Estado. Esse paradigma foi superado com o advento da Lei de Migração (Lei no 13.445, de 24 de maio de 2017), cuja principal característica é o reconhecimento dos direitos humanos dos migrantes. O referido instrumento trouxe como uma de suas principais inovações o instituto da acolhida humanitária, que visa a proteção de migrantes em determinadas situações de vulnerabilidade. A regulamentação da Lei, ocorrida por meio do Decreto no 9.199, de 20 de novembro de 2017, não se mostrou alinhada aos objetivos daquele diploma legal, afetando, inclusive, a operacionalização do instituto supramencionado. O presente trabalho pretende, em primeiro momento, analisar a evolução da legislação migratória brasileira, desde a construção do paradigma da segurança nacional, até sua superação, com a Lei de Migração, de 2017. Em sequência, partindo da análise prática e normativa da acolhida humanitária, procura-se demonstrar como a regulamentação e operacionalização do diploma legal enfraqueceu o referido instituto, remontando a práticas semelhantes àquelas perpetradas durante a vigência do antigo paradigma legislativo.

Brazilian immigration legislation and the national policies shaped by it were conceived, throughout the 20th century, under the security optics. Such operational logic considered migrants as a threat to national sovereignty, practicing discriminatory treatments with them, marked by the selective recognition of rights and operationalized through discretionary power of the State. This paradigm was overcome with the advent of the Migration Law (Law No. 13,445, of May 24th, 2017) whose main characteristic is the recognition of the human rights of migrants. This instrument brought as one of its main innovations the institute of humanitarian admission, which aims to protect migrants in certain situations of vulnerability. The regulation of the Law, which took place through Decree No. 9,199, of November 20th, 2017, was not aligned with the objectives of that legal diploma, affecting the operationalization of the aforementioned institute. The present work intends, at first, to analyze the evolution of the Brazilian migration legislation, from the construction of the national security paradigm, to its overcoming, through the Migration Law of 2017. In sequence, analyzing the practical and the normative of the humanitarian admission, it seeks to demonstrate how the regulation of the legal diploma weakened the previously mentioned institute, bringing back practices similar to those perpetrated during the validity of the old legislative paradigm.
