Apoiado em fontes históricas e teóricas, o presente trabalho se propõe a investigar como os discursos sobre a corrupção política moldaram instituições e práticas concretas voltadas à sua repressão no Brasil. Tais ações foram inicialmente fomentadas pelo Poder Executivo, sobretudo no primeiro governo de Getúlio Vargas e no período da Ditadura Militar e, após a promulgação da Constituição de 1988, impulsionadas pelo Poder Judiciário, sob direta influência de modelos elaborados por instituições internacionais. No contexto democrático, a pesquisa se apoia na análise de jurisprudência de casos paradigmáticos, buscando identificar critérios utilizados pelos tribunais para interpretar os elementos normativos dos tipos penais de corrupção passiva e ativa. As evidências recolhidas sugerem que o âmbito de proibição da norma penal foi ampliado, passando a incriminar condutas que antes eram consideradas lícitas. Isso, argumenta-se, criou zonas de incerteza quanto à sua incidência na esfera das relações entre atores privados e agentes políticos, provocando efeitos deletérios sobre a funcionalidade do sistema político. Ao final, são propostos critérios retificadores de natureza político-criminal e diretrizes à interpretação dos tipos penais de corrupção passiva e ativa, visando à delimitação de sua zona de proibição.

Supported by historical and theoretical sources, the present work aims to investigate how discourses on political corruption shaped institutions and concrete practices intended for its repression in Brazil. These actions were initially promoted by the Executive Power, especially in the Getúlio Vargas administration and in the Military Dictatorship; then, with the promulgation of the 1988 Constitution, they were driven by the Judiciary, under the direct influence of models developed by international institutions. In the democratic context, the research is based on the analysis of precedents of paradigmatic cases, seeking to identify which criteria the courts employ to interpret the crimes normative elements on passive and active corruption. The evidence gathered suggests that the scope of prohibition covered by the criminal law was expanded, commencing to incriminate conducts that were previously considered legal. It is concluded that areas of uncertainty were created, which affect the relations between private actors and political agents, inducing deleterious effects on the functionality of the political system. Ultimately, the article proposes political-criminal criteria able to rectify the interpretation of the criminal types of passive and active corruption, contributing to the delimitation of its prohibited zone.
