A presente dissertação teve por objetivo analisar de que forma a Bioética se relaciona com a regulamentação dos Organismos Geneticamente Modificados (OGMs), sob um recorte específico, que abrangeu países ou blocos regionais, para então compará-los ao sistema adotado no Brasil. Para tanto, selecionamos os EUA e a Comunidade Europeia, pela destacada importância, seja como atores no comércio internacional, seja pela forte influência que exercem sobre nosso sistema jurídico. Ao tratar do assunto relativo ao direito positivado que regula a matéria, demos ênfase aos fundamentos da Bioética que devem nortear a formação do direito posto para regular esse ramo da ciência. Considerando que os alimentos transgênicos, são atualmente uma realidade, o estudo examinou a literatura sobre a matéria, procurando sistematizar esse complexo assunto, de forma a contribuir para que sejam disponibilizadas, ao mundo acadêmico e a sociedade civil como um todo, uma sistematização organizada que ajude a formação de opinião sobre como devem ser regulados os OGMs. Dessa forma, observamos os sistemas regulatórios dos EUA, que abrangem suas agências reguladoras, que exercem influência no mundo ocidental capitalista. Por outro lado, enveredamos pelo sistema vigente na Comunidade Europeia, para então dedicarmos especial atenção ao sistema brasileiro, abordando inclusive questões jurídicas que ainda pairam sobre nosso sistema regulatório de OGMs. Conforme pudemos constatar, a complexidade do tema é enorme, e apontamos características comuns entre os sistemas analisados e sua relação com a Bioética, bem como tecemos críticas sobre pontos que, em nossa visão, merecem mais atenção, com possibilidade de evolução de nosso sistema legal posto, de modo a acompanhar as atuais tendências do setor. Nesse contexto, de análises abrangentes e interdisciplinares, somadas ao momento pós-positivista que o mundo jurídico vive, que desenvolvemos a presente dissertação ousando analisar a questão sob esses dois aspectos, a lei positivada na forma de regulamentos, mas sem deixar de incluir nessa discussão, a faceta humana que a Bioética nos traz.

This dissertation aimed to analyze how Bioethics relates to the regulation of Genetically Modified Organisms (GMOs), under a specific cut, which covered countries or regional blocks, and then compare them to the system adopted in Brazil. For this purpose, we selected the USA and the European Community, due to their outstanding importance, either as actors in international trade or due to the strong influence they exert on our legal system. When dealing with the subject related to the positive law that regulates the matter, we emphasized the fundamentals of Bioethics that should guide the formation of the law set to regulate this branch of science. Considering that transgenic foods are currently a reality, the study examined the literature on the matter, seeking to systematize this complex subject, in order to contribute to making available, to the academic world and civil society as a whole, an organized systematization that help shape opinion on how GMOs should be regulated. In this way, we look at the US regulatory systems, which encompass its regulatory agencies, which exert influence in the Western capitalist world. On the other hand, we followed the current system in the European Community, and then dedicated special attention to the Brazilian system, including addressing legal issues that still hover over our regulatory system for GMOs. As we could see, the complexity of the subject is enormous, and we point out common characteristics between the analyzed systems and their relationship with Bioethics, as well as we criticize points that, in our view, deserve more attention, with the possibility of evolution of our legal system post, in order to keep up with current trends in the sector. In this context, of comprehensive and interdisciplinary analyses, added to the post-positivist moment that the legal world lives, that we developed the present dissertation daring to analyze the question under these two aspects, the law positivized in the form of regulations, but without forgetting to include in this discussion , the human facet that Bioethics brings us.
