A presente tese tem como escopo examinar a política criminal como uma política pública. Para tanto, foram traçadas algumas hipóteses sobre as razões pelas quais, em termos teóricos, a política criminal não é estudada como política pública, ao menos no que diz respeito ao campo teórico pertinente às ciências criminais no âmbito jurídico. A partir do reposicionamento epistemológico da análise da política pública criminal, a tese utiliza tanto o repertórico teórico da criminologia como aquele derivado da ciência política para examinar a política criminal desde a fase de formação da agenda, passando pela implementação e encerrando na fase de avaliação, relacionando este ciclo ao populismo penal. A tese também examina o encarceramento como efeito ou impacto da política criminal referente aos crimes aquisitivos, entendidos como aqueles decorrentes da política criminal de drogas e dos delitos contra o patrimônio. Por fim, é examinada a relação entre a política pública criminal e o Estado democrático.

This thesis aims to examine criminal policy as a public policy. Therefore, some hypotheses of why criminal policy is not studied as public policy were outlined in theoretical terms, at least with regard to the theoretical field of the criminal sciences in the legal courses. Based on the epistemological repositioning of the analysis of criminal public policy, the study uses the theoretical tools of criminology as well as the concepts derived from political science to examine criminal policy from the agenda-setting phase, through implementation and ending in the evaluation phase, relating this cycle to penal populism. The study also examines incarceration as an effect or impact of criminal policy related to acquisitive crimes, understood as those resulting from drug policy and crimes against property. Finally, the relationship between criminal public policy and the democracy is examined.
