A presunção de inocência configura princípio estruturante do processo penal em qualquer ordenamento democrático. Trata-se de valor construído desde a antiguidade romana, concebido a partir da necessidade de preservar os acusados em geral contra julgamentos precipitados, antes da comprovação da culpa. Entretanto, o ordenamento brasileiro condiciona a superação do estado de inocência ao trânsito em julgado da decisão condenatória. A partir da análise histórica e estrutural do princípio, o trabalho buscará avaliar a eficácia do modelo brasileiro na proteção dos direitos fundamentais dos acusados no processo penal brasileiro.

The presumption of innocence configures the structuring principle of the criminal process in any democratic order. It is a value constructed since Roman antiquity, conceived from the necessity of preserving the accused in general against hasty trials, before the proof of guilt. However, the Brazilian ordinance conditions the overcoming of the state of innocence to the res judicata of the condemnatory decision. From the historical and structural analysis of the principle, the paper will seek to evaluate the effectiveness of the Brazilian model in protecting the fundamental rights of the accused in the Brazilian criminal process.
