A presente dissertação de mestrado tem como objetivo estudar e analisar a estabilização da tutela antecipada, técnica incluída no ordenamento jurídico brasileiro no Código de Processo Civil de 2015, por meio da apresentação de diferentes perspectivas doutrinária e jurisprudencial a respeito dos dispositivos que regulam a matéria na busca de uma melhor interpretação. Constituindo técnica nova no sistema jurídico brasileiro, é apresentada sua finalidade, além de examinada, de forma breve, a evolução histórica dos projetos de lei elaborados até a sua positivação, com a aprovação da Lei 13.105/15. Visando a contribuir para a compreensão do tema é analisada a técnica da cognição, como elemento estrutural das tutelas jurisdicionais diferenciadas, dentre as quais é examinada de modo mais aprofundado em um capítulo próprio, a tutela provisória, cujas espécies são as tutelas de evidência e urgência, da qual são subespécies a tutela cautelar e a tutela antecipada. A seguir, com base nos conceitos e premissas fixados, é promovido estudo da estabilização da tutela antecipada, analisando seus pressupostos, aspectos procedimentais, elementos estruturais, consequências, forma de confirmar, invalidar ou reformar a tutela antecipada estabilizada, bem como seus limites.

This master's dissertation aims to study and analyze the stabilization of interlocutory relief a technique introduced in the Brazilian legal system through the Civil Procedure Code of 2015 by means of assessing perspectives from different scholarship and case law regarding the legal devices that regulate the matter, in an attempt of reaching a better interpretation. As the stabilization of interlocutory relief represents a new technique in our legal system, its purpose is discussed, alongside a brief examination of the historical evolution of the bills that have been drafted up to its enactment, in the form of Law No. 13,105/2015. As to contribute to the understanding of the topic, the cognition technique is explored as a structural element of the differentiated jurisdictional protections. Among those, a specific chapter is dedicated to examining in more detail interim relief, which has urgency and evidence-based injunctions as species, and precautionary and interlocutory reliefs as subspecies. Based on the established concepts and premises, a study on the stabilization of interlocutory relief follows, analyzing its assumptions, procedural aspects, structural elements, consequences, requisites for confirmation, invalidation or reform of stabilized interlocutory reliefs, as well as their limits.
