A presente tese aborda o tema da valoração e da decisão sobre a prova penal, visando estabelecer um ambiente de maior controle nessa seara. Parte-se de um exame dos fundamen- tos de base, especialmente acerca do papel da verdade, da probabilidade e dos momentos pro- batórios no decorrer da persecução penal, bem como os pressupostos para a construção de uma decisão correta. A partir daí, busca-se diferenciar os modelos probatórios subjetivo e ob- jetivo, filiando-se, teoricamente, a um modelo objetivo. Isso significa que devem ser buscados critérios para que o juiz analise a prova, considerando que o material informacional produzido estará no cerne do sistema, e não o convencimento do julgador. Aponta-se, em tom crítico, como a jurisprudência das Cortes de Vértice interpreta subjetivamente o sistema probatório penal brasileiro. A fim de se alterar esse estado de coisas, buscar-se-á, na segunda parte, dis- cutir as bases conceituais e funcionais da valoração e apresentar alguns critérios para tornar essa tarefa menos discricionária. Ainda, procura-se analisar os contornos do instituto do es- tândar de prova, com o objetivo de construir parâmetros mais seguros para que se possa deci- dir sobre a prova penal e, consequentemente, viabilizar que exista uma possibilidade de con- trole intersubjetivo sobre a decisão penal.

This paper addresses the issue of assessment and decision on criminal evidence, aiming to establish an environment of greater control in this area. It starts with an examination of the basic fundamentals, especially regarding the role of truth, probability and probative moments in the course of criminal prosecution, as well as the assumptions for the construction of a correct decision. From there, it is sought to differentiate the subjective and objective evi- dentiary models, affiliating, theoretically, to an objective model. This means that criteria must be sought for the judge to analyze the evidence, and it is the informational material produced that will be at the heart of the system, and not the conviction of the judge. It points out, in a critical tone, how the jurisprudence of the Supreme Courts interprets subjectively the Brazili- an criminal evidentiary system. In order to change this state of affairs, the second part seeks to discuss the conceptual and functional bases of evidence assessment and present some criteria to make this task less discretionary. Still, it seeks to analyze the contours of the institute of standard of proof, with the objective of building safer parameters so that one can decide on the criminal evidence and, consequently, enable the existence of a possibility of intersubjec- tive control over the criminal decision.
