O presente trabalho visa a responder de que forma o dever de cooperação positivado no Código de Processo Civil atual conforma a atuação judicial nos processos regidos por convenção processual. Para tanto, parte-se da premissa de que a cooperação é fenômeno existente fora do processo (e inclusive fora do direito), e também na arbitragem. Na segunda parte do trabalho, busca-se sistematizar e explicar as condutas que se espera do julgador diante de processos regidos por convenção processual ou que possam sê-lo, representadas nas funções de fomento, controle e aplicação dos negócios jurídicos processuais

The present study aims to answer how the cooperation duty imposed by the current Code of Civil Procedure conforms the judicial acting in the lawsuits governed by procedural agreements. In order to do so, it starts with the premise that cooperation is a phenomenon that can be observed outside civil procedure (and even outside the law), and also in arbitration. In the second part of the paper, it seeks to systematize and explain the conducts that are expected from the judge in relation to actions governed by or which may be governed by procedural agreements, represented in the functions of incentive, control and application of contractualized procedures
