O objetivo deste estudo é analisar a boa-fé como princípio realizador da proteção ao trabalho, principalmente quando da extinção contratual, voltado a inibir práticas ilegais encobertas por dispensas imotivadas e sem justa causa. A premissa se estabelece no histórico de construção do Direito do Trabalho, imerso nos Direitos humanos fundamentais que, apesar de em constante conflito com o capital e sua lógica compensatória, identifica na boa-fé fundamento basilar para a garantia mínima civilizatória do trabalhador cidadão, que muitas vezes se vê diante de ilegalidades, quando da cessação de seu contrato de trabalho, ou quando de sua iminência, sem qualquer expectativa de efetividade de seus direitos fundamentais.

The objective of this study is to analyze the good faith as a principle that promotes labor protection, especially when contractual termination, with the intention of inhibiting illegal practices covered by unjustified and unjustified dismissals. The premise is established in the history of construction of Labor Law, immersed in fundamental human rights that, despite being in constant conflict with capital and its compensatory logic, identifies in the good faith the basic foundation for the minimum civilizing guarantee of the citizen worker, who many times he is faced with illegalities, when his employment contract is terminated, or when it is imminent, without any expectation of following his fundamental rights.
