O presente estudo tem por objetivo analisar, sob a perspectiva labor-ambiental, a gestão dos riscos/perigos (conhecidos ou não) decorrentes uso de nanotecnologias, diante da ausência de regulamentação específica. Utilizamos como fio condutor (i) análise períodos históricos em que a evolução tecnológica impôs significativas mudanças no Direito (a posteriori); (ii) análise da resposta do Direito à época; (iii) semelhanças e diferenças entre o período histórico em questão e a atual quadra da História; (iv) repostas oferecidas pelo sistema normativo-constitucional brasileiro atual; (v) a inadequação da responsabilidade civil com culpa diante dos potenciais riscos nanotecnológicos em matéria laborambiental; (vi) como o Direito Ambiental do Trabalho, com os princípios que lhe são inerentes aborda os riscos em suas diferentes apresentações; (vii) finalmente, analisamos o princípio da precaução, seus requisitos de aplicabilidade e repercussões no manejo de potenciais riscos nanotecnológicos no meio ambiente do trabalho e seus reflexos.

The present study analyzes the methods of occupational risks/hazards (known or not) assessment related to the use of nanotechnologies within a context of lack of regulation. For that, Environmental Labor Law and its principles were used as a premise, especially the precautionary principle. Firstly, the research reviews the relevant historical periods in which technological evolution induced important changes in Law (a posteriori). Then, the similarities and differences between the historical period in question and the current period of History are compared. As such, the research systematizes the main issues raised by a risk society paradigm and the civil Aquilian liability standard adopted so far. Furthermore, the response of the Brazilian constitutional system to typical emerging technologies new risks was investigated. One observes a tendency of the Legal System to strengthen the principles of environmental law in order to prevent damage. Hence, the precautionary principle plays a key role in environmental labor law.
