Esta tese é organizada em quatro capítulos: A Era da Informação; Proteção de Dados e Autodeterminação Informativa; Inteligência Artificial e Sociedade de Controle; e Autodeterminação Informativa e Regulação das Plataformas Digitais. Iniciamos com uma revisão das características e aspectos históricos da Era da Informação, bem como com a análise da relação desta com o processo de digitalização das relações sociais em diversos âmbitos, inclusive econômicos, culturais, políticos e legais. Examinamos como as tecnologias da informação e da comunicação influenciam categorias básicas que estruturam os sistemas sociais e jurídicos modernos, bem como a filosofia e a ética da informação. No segundo capítulo, nos concentramos na proteção dos dados pessoais e no princípio da autodeterminação informativa, traçando suas origens e evoluções doutrinárias, legislativas e jurisprudenciais tanto no Brasil quanto internacionalmente. Avaliamos também a nossa hipótese de trabalho, ao comprovarmos a relativa falta de efetividade das leis e regulamentos recentes que visaram disciplinar tais matérias. O terceiro capítulo se dedica ao estudo do fenômeno que se denomina "sociedade de controle", conforme conceituado por Gilles Deleuze, logo no começo da década de 90. Exploraremos, nesta parte, os instrumentos que sustentam essa nova forma digitalizada e globalizada de organização social, principalmente a inteligência artificial, e como conduz a uma excessiva concentração de poder e informação nas mãos de poucas pessoas e instituições. O quarto e último capítulo aborda o conceito de liberdade na modernidade e sua relação com as noções de privacidade, proteção de dados e autodeterminação informativa na contemporaneidade. Apresentamos uma nova interpretação do princípio da autodeterminação informativa, mais adequada ao universo informacional e comunicativo atual, e propomos as premissas básicas para uma nova regulação dos meios e plataformas digitais. A tese argumenta que as referidas leis e regulamentos sobre proteção de dados não são suficientes para se contraporem a todas as formas de dominação e controle que emergem do universo informacional em que estamos inseridos. Propõe, portanto, uma reavaliação dessas normas e busca adequar o nosso ordenamento jurídico ao melhor interesse de nossa sociedade, confrontando as verdadeiras causas de tal falta de efetividade e propondo soluções para combater as mazelas e injustiças que advêm da "sociedade de controle".

This thesis is organized into four chapters: The Information Age; Data Protection and Information Self-Determination; Artificial Intelligence and Society of Control; and Information Self-Determination and Regulation of Digital Platforms. We begin with a review of the characteristics and historical aspects of the Information Age, as well as an analysis of its relationship with the process of digitalization of social relations in various spheres, including economic, cultural, political, and legal ones. We examine how information and communication technologies influence basic categories that structure modern social and legal systems, as well as the philosophy and ethics of information. In the second chapter, we focus on the protection of personal data and the principle of informational self-determination, tracing their origins and doctrinal, legislative, and case-law developments both in Brazil and internationally. We also evaluate our working hypothesis, by proving the relative lack of effectiveness of recent laws and regulations aimed at disciplining such legal precepts. The third chapter is dedicated to the study of the phenomenon called society of control, as conceptualized by Gilles Deleuze, at the beginning of the 90s. In this part, we will explore the instruments that support this new digitized and globalized form of social organization, mainly artificial intelligence, and how it leads to an excessive concentration of power and information in the hands of a few individuals and institutions. The fourth and final chapter deals with the concept of freedom in modernity and its relationship with notions of privacy, data protection, and informational self- determination in contemporary times. We present a new interpretation of the principle of informational self-determination, more appropriate to the current informational and communicative universe, and propose the basic premises for a new regulation of digital media and platforms. The thesis argues that the aforementioned laws and regulations on data protection are not sufficient to oppose all forms of domination and control that emerge from the informational universe in which we are inserted. It proposes, therefore, a reassessment of these norms and seeks to adapt our legal system to the best interest of our society, confronting the true causes of such lack of effectiveness and proposing solutions to combat the afflictions and injustices that come from the "society of control".
