Através deste trabalho, pretende-se analisar a estrutura da proteção do patrimônio cultural dos povos indígenas no Brasil no campo dos Direitos Humanos e Fundamentais Culturais. Para tanto, será realizada uma observação da presença da proteção da Cultura no Direito; uma análise da proteção jurídica do Patrimônio Cultural Imaterial (PCI) dos povos indígenas, tanto em esfera internacional e regional quanto em esfera doméstica; uma introdução ao conceito de etnocídio, bem como o apontamento de desafios pelos quais os povos indígenas e suas culturas vêm passando; e uma verificação de alternativas jurídicas e políticas para aumentar a eficiência da proteção do PCI dos povos indígenas: iniciativas da sociedade civil organizada e a aplicação no Brasil de ideias do Novo Constitucionalismo Latino-americano. O problema investigado nesta pesquisa é: como se dá a proteção do patrimônio cultural dos povos indígenas no Brasil? Quais são os seus desafios e como enfrenta-los? O objetivo central a ser alcançado nesta pesquisa é a reflexão acerca da forma como se dá a proteção do PCI dos povos indígenas. Já os objetivos específicos são: averiguar a presença da Cultura e conceitos correlatos no Direito; analisar a proteção jurídica do PCI dos povos indígenas em esfera internacional e doméstica; verificar ameaças sofridas atualmente pelas culturas indígenas no mundo fático; e averiguar alternativas jurídicas e políticas para aumentar a eficiência da proteção do PCI dos povos indígenas contra tais ameaças. Esse trabalho utilizará como métodos: o levantamento bibliográfico de livros, pesquisas e artigos sobre a salvaguarda do patrimônio cultural, principalmente o patrimônio cultural de natureza imaterial, e sobre os povos indígenas; a pesquisa legislativa de instrumentos internacionais, da Constituição Federal, da legislação brasileira e de normas infralegais acerca da proteção ao patrimônio cultural imaterial e aos povos indígenas; e a análise dos precedentes judiciais do Supremo Tribunal Federal e da Corte Interamericana de Direitos Humanos sobre o tema.

Throughout this work, we intend to analyze the structure of the protection of the cultural heritage of indigenous peoples in Brazil in the field of the Human and the Fundamental Cultural Rights. For this purpose, will be made: an observation will be made of the presence of the protection of the Culture in Law; an analysis of the legal protection of the Intangible Cultural Heritage (ICH) of indigenous peoples, both at the international and regional level and at the domestic level; an introduction to the concept of ethnocide, as well as highlighting challenges that indigenous peoples and their cultures have been going through; and, finally, a verification of legal and political alternatives to increase the efficiency of the protection of the ICH of the indigenous peoples: civil society initiatives and the application of ideas from the New Latin American Constitutionalism in Brazil. The problem investigated in this research is: how is the cultural heritage of indigenous peoples protected in Brazil? Which are its challenges and how to face them? The central objective to be achieved in this research is to consider on how the ICH protects indigenous peoples. The specific objectives are: to investigate the presence of Culture and related concepts in Law; analyze the legal protection of the ICH of the indigenous peoples at international and national levels; verify threats currently suffered by indigenous cultures in the factual world; and investigate legal and political alternatives to increase the efficiency of ICH protection of indigenous peoples against such threats. This work will use the following methods: bibliographical survey of books, research and articles on the safeguarding of cultural heritage, especially cultural heritage of an intangible nature, and on indigenous peoples; legal research into international instruments, the Federal Constitution, Brazilian legislation and infra-legal norms regarding the protection of intangible cultural heritage and indigenous peoples; and the analysis of judicial precedents from the Brazilian Supreme Court and the Inter-American Court of Human Rights on the topic.
