O presente trabalho visa realizar uma avaliação da problemática em torno do dano ambiental e da aplicação das teorias de risco em responsabilidade civil ambiental pelo Superior Tribunal de Justiça em suas decisões, questionando a delimitação do conceito de Teoria do Risco Integral pelo Tribunal, que considera sua aplicação nos casos de responsabilidade civil ambiental como pacificada. A dissertação abordará (i) os avanços tecnológicos e o advento da sociedade de risco do século XXI em paralelo à questão ambiental, (ii) o conceito de dano ambiental e suas dimensões que o diferenciam do entendimento tradicional de dano; (ii) a dificuldade de se reparar dano ambiental pelo seu caráter complexo e, muitas vezes, imprevisível, devido à incerteza científica, que é característica de uma sociedade de risco; (iii) a capacidade de adequação da responsabilidade civil às novas circunstâncias fáticas e sociais; (iv) o princípio do poluidor-pagador como norteador do direito Ambiental; (v) as teorias de risco e a problemática da atenuação do nexo causal para a configuração de responsabilidade civil ambiental; (vi) críticas à aplicação da responsabilidade civil ambiental sob a modalidade da teoria do risco integral; e (vii) a análise dos julgados do Superior Tribunal de Justiça, em que há referência e construção do conceito de teoria do risco integral, bem como sua aplicação às diferentes dimensões do dano ambiental, com base na teoria da argumentação e na Nova Retórica desenvolvidas por Chaïm Perelman.

This dissertation aims to carry out an assessment of the problem surrounding environmental damage and the application of risk theories in environmental civil liability by the Superior Court of Justice in its decisions, questioning the delimitation of the concept of Integral Risk Theory by the Court, which considers its application in cases of environmental civil liability as pacified. The dissertation will address (i) the development of technology and the advent of the 21st century risk society in parallel to the environmental issue, (ii) the concept of environmental damage and its dimensions that differentiate it from the understanding of civil damage; (ii) the difficulty of repairing environmental damage due to its complex and often unpredictable characteristic, due to scientific uncertainty, which, in its turn, is characteristic of a risk society; (iii) the possibility of the civil liability to adapt to the new factual and social circumstances; (iv) the relevance of the polluter-pays principle in Environmental Law; (v) risk theories and the problem of mitigating the causal link for the configuration of environmental civil liability; (vi) criticisms of the application of environmental liability under the integral risk theory; and (vii) the analysis of the Superior Court of Justice judges, in which there is reference and construction of the concept of integral risk theory, as well as its application to the different dimensions of environmental damage, based on the theory of argumentation and the New Rhetoric developed by Chaïm Perelman.
