O presente trabalho tem por objetivo o estudo da política de cotas para negros nas universidades públicas e sua compatibilidade com os princípios constitucionais da igualdade e da proporcionalidade. O estudo traz como principal referência a experiência norte-americana, buscando adaptá-la à nossa realidade nacional, mediante análise de projetos de lei e de ações já adotadas em algumas universidades públicas brasileiras. Portanto, esta pesquisa aborda as principais divergências a respeito da implementação da reserva de vagas para negros e a possibilidade de se estabelecer um sistema de discriminação positiva para a efetiva proteção dos direitos humanos.

Abstract in English
The present paper has the purpose of studying the quotas policy for Black population in public universities and their compatibility with the equality and solidarity in the constitutional principles. As a principal reference, the research brings the American experience, looking for its adaptation in our national reality through the analysis of law projects and actions already adapted for Brazilian public universities. Therefore, this research broaches the principal disagreements about the introduction of quotas policy for black population and the possibility of establishing a positive discrimination system for the effective protection of human rights.
