A violência doméstica contra a mulher cometida por parceiro íntimo é a forma mais generalizada de agressão contra as mulheres. Nesses casos, a preponderância da violência psicológica é muito expressiva, ultrapassando os índices de agressões físicas, em vários estudos recentes. Assim, para a verificação de como o Poder Judiciário tem lidado com esse tipo de ocorrência, analisou-se todos os processos judiciais do Anexo de Violência Doméstica e Familiar contra a Mulher, de Ribeirão Preto, relativos à violência cometida por parceiros íntimos, propostos de 2018 a 2019 e encerrados e arquivados até 2019, mediante pesquisa documental quantitativa com abordagem qualitativa, desenvolvida por meio de análise descritiva e percentual dos dados e, em seguida, da análise combinada de informações levantadas juntamente com o exame pontual de relatos expressos pelas vítimas, como corroboração para os dados encontrados no tratamento quantitativo. O que se observou, entre outras evidências, foi que, no atendimento às vítimas, desde o registro da ocorrência junto às forças de segurança e durante os processos judiciais, foi uma expressiva relevância dada às agressões e resultados físicos e pouca ou nenhuma consideração às agressões e consequências mentais. Inclusive, com a total exclusão ou desprezo dessas práticas, ainda que configuradoras de condutas legalmente previstas como crimes e declaradas pelas vítimas. Verificou-se também que nenhum dos processos considerou o aspecto psicológico que pode ter havido em razão das lesões corporais sofridas, não sendo possível afirmar se não houve consequências psicológicas ou se essas informações apenas não foram buscadas, haja vista que nenhuma averiguação foi efetuada e 100% das perícias foram apenas físicas. Mesmo quanto ao aspecto físico, os dados indicaram que as classificações utilizadas parecem subestimar os prejuízos advindos da violência. Todas as lesões sofridas foram consideradas leves, mesmo com mais de 55% delas terem sido cometidas contra áreas sensíveis, como cabeça, coluna e abdome, e com o número de lesões observadas tendo sido quatro vezes maior que o número de casos a que se referiam. Já em relação às medidas protetivas de urgência, levantou-se que na maioria dos processos há o requerimento e a concessão delas, mas as que são deferidas não correspondem forçosamente às que foram solicitadas. Ademais, apurou-se que em quase 35% dos processos as medidas protetivas não impedirem novas agressões, observando-se, em vários casos, o estrito respeito ao direito à liberdade do acusado, mas que resultaram no total descumprimento do direito à integridade física e mental das vítimas. A violência psicológica apresenta-se como a porta de entrada para a violência física, pois, a segunda é, em regra, precedida da primeira. Ademais, possui graves consequências à saúde da mulher, incluindo danos físicos e mentais, impactando todos os setores de sua existência. Sem essas ponderações não é possível conhecer o efetivo custo da violência cometida por parceiro íntimo e não se levará em conta, talvez os principais prejuízos decorrentes das agressões. Concluiu-se, assim, que a tutela integral buscada às vítimas parece ainda não ter sido alcançada, reconhecendo-se, mesmo hoje, apenas parcialmente as efetivas circunstâncias em que estão inseridas as vítimas.

Domestic violence against women perpetrated by an intimate partner is the most common form of aggression against women. In these cases, the preponderance of psychological violence is very significant, surpassing the rates of physical aggression in several recent studies. Therefore, in order to see how the judiciary has dealt with this type of occurrence, we analyzed all court cases from the Ribeirão Preto Domestic and Family Violence against Women Annex, related to intimate partner violence, proposed from 2018 to 2019 and closed and filed until 2019, through quantitative documentary research with a qualitative approach, developed by means of descriptive and percentage analysis of the data, followed by a combined analysis of the information collected together with a specific examination of the reports expressed by the victims, as corroboration of the data found in the quantitative treatment. What was observed, among other things, was that in the care given to the victims, from the moment the incident was registered with the security forces and during the judicial process, there was a significant emphasis on physical aggression and its consequences, and little or no consideration of mental aggression and its consequences. In fact, these practices were completely excluded or disregarded, even though they constituted behaviors that were legally defined as crimes and reported by the victims. It was also found that none of the cases took into account the psychological aspect that can be caused by aggression. It was also found that none of the cases considered the psychological aspect that may have occurred as a result of the physical injuries suffered. It is not possible to say whether there were no psychological consequences or whether this information was simply not sought, since no investigation was carried out and 100% of the examinations were only physical. Even with regard to the physical aspect, the data showed that the classifications used seem to underestimate the damage caused by violence. All the injuries suffered were considered minor, although more than 55% of them were inflicted on sensitive areas such as the head, spine and abdomen, and the number of injuries observed was four times higher than the number of cases to which they referred. With regard to emergency protective measures, it was noted that they were requested and granted in most cases, but that those granted did not necessarily correspond to those requested. In addition, it was found that in almost 35% of the cases the protective measures did not prevent further aggression, and in several cases the right to liberty of the accused was strictly respected, but the victims' right to physical and mental integrity was completely disregarded. Psychological violence is the gateway to physical violence, as the latter is usually preceded by the former. In addition, it has serious consequences for women's health, including physical and psychological damage that affects all areas of their lives. Without these considerations, it is not possible to know the true cost of intimate partner violence, and perhaps the most important damage caused by aggression is not taken into account. In conclusion, it seems that the desired comprehensive protection of victims has not yet been achieved, and even today, the actual circumstances in which victims find themselves are only partially recognized.
