A condução da lavra em um empreendimento mineiro deve ser vinculada ao responsável técnico, profissional que responde pela correta operação de uma empresa perante os conselhos de classe e os órgãos públicos competentes. O vínculo deste profissional é obrigatório e indispensável para que as empresas recebam as devidas instruções e estejam regulares. Para compreender a prática desses profissionais é necessário analisar os requisitos de responsabilidade técnica, encontrados na legislação brasileira. Desta maneira, objetivou-se analisar, comparativamente, os requisitos legais, de competências e de atribuições profissionais de responsabilidade técnica observados no Brasil e no Canadá, tendo como foco desta pesquisa a província de Ontario, selecionada devido à sua economia ser amplamente impulsionada pela atividade de mineração. O objetivo deste estudo foi verificar as semelhanças e diferenças entre os modelos de ambos os países. Os resultados indicaram uma divergência em três aspectos. A interpretação dos resultados sugeriu que o modelo brasileiro se encontra desatualizado em relação às práticas observadas no Canadá, referentes aos requisitos de credenciamento profissional, educação continuada e experiência prévia dos profissionais.

Abstract in English
The conducting of mining operations should be overseen by the technical responsible, a professional accountable for ensuring the proper functioning of a company in compliance with relevant professional councils and governmental agencies. This role is essential and mandatory for businesses to obtain accurate guidance and to avoid penalties, such as fines due to inadequate advice. To comprehend the practices of these experts, an examination of the technical responsibility criteria outlined in Brazilian law is necessary. Consequently, the study aimed to conduct a comparative analysis of the legal requirements, competencies, and professional attribution related to technical responsibility in Brazil and Canada, with a focus on Ontario. This province was chosen because its economy is heavily reliant on mining activities. The purpose of the research was to identify similarities and discrepancies in the approaches of both nations. The findings reveal variances in three key areas. Interpreting these results, it appears that the Brazilian framework is outdated compared to the practices observed in Canada, particularly concerning professional accreditation standards, ongoing education, and the prior experience of the professionals.
