Esta dissertação apresenta os caminhos das lutas em torno da criminalização da LGBTfobia no Brasil entre 1980 e 2019. Com o objetivo de compreender se e em que medida a emergência das lutas pela criminalização da LGBTfobia se vincularia a um giro punitivo neoliberal na relação do ativismo LGBT com o cistema penal, constrói-se uma genealogia da emergência da LGBTfobia como questão de crime e das disputas em jogo à luz dos processos históricos de democratização, neoliberalização e expansão da justiça criminal. Por meio de uma análise sociológica de discursos, analisam-se tanto documentos do movimento LGBT brasileiro, projetos de lei e ações judiciais quanto entrevistas semiestruturadas realizadas com ativistas LGBTs. Argumenta-se que, embora nos anos 1980 a criminalização emergisse como tática, em meados dos anos 2000, as lutas anti-LGBTfobia hegemônicas foram reenquadradas em quadros de crime e passaram a ser construídas como necessária, porém não exclusivamente, criminalizantes. As lutas pela criminalização, enquanto uma forma de mobilização do governo pelo crime "desde baixo" dentro do processo de redemocratização e neoliberalização da sociedade brasileira, foram produzidas dentro de um complexo jogo de táticas e discursos mobilizados por ativistas que teve como efeito o enraizamento de uma "racionalidade criminalizante" nos ativismos hegemônicos. Apresenta-se que, nesse processo histórico, estratégias anticriminalizantes e/ou anticarcerárias de combate à LGBTfobia se articularam e se contrapuseram de diferentes formas ao estatuto hegemonicamente conferido à estratégia de criminalização, tendo se configurado um continuum carcerário-abolicionista de múltiplas e ambivalentes formas de engajamento e recusa das racionalidades neoliberal e criminalizante nos caminhos de combate à LGBTfobia no Brasil.

This dissertation presents the path of the struggles for the criminalization of LGBTphobia in Brazil between 1980 and 2019. In order to understand whether and to what extent the emergence of struggles for the criminalization of LGBTphobia would be linked to a neoliberal punitive turn in the relationship of LGBT activism with the penal system, we build a genealogy of the emergence of LGBTphobia as a matter of crime and of the disputes at stake in the light of the historical processes of democratization, neoliberalization and the expansion of the criminal justice. Through a sociological discourse analysis, we analyse documents from the Brazilian LGBT movement, bills and lawsuits, as well as semi-structured interviews with LGBT activists. It is argued that, although the criminalization demand emerged as a tactic in the 1980s, in the mid-2000s, hegemonic anti-LGBTphobia struggles were reframed in crime frames and started to be constructed as necessary, but not exclusively, criminalizing. The struggles for criminalization, as a form of mobilizing governing through crime "from below" within the process of redemocratization and neoliberalization of Brazilian society, were produced within a complex set of tactics and discourses mobilized by activists that had the effect of rooting a "criminalizing rationality" in hegemonic activisms. It is demonstrated that, in this historical process, anti-criminal and/or anti-prison strategies to fight LGBTphobia were articulated and opposed in different ways to the hegemonic status conferred to the criminalization strategy, in a configuration of a prison-abolitionist continuum of multiple and ambivalent forms of engagement and refusal of neoliberal and criminalizing rationalities in the path of fighting against LGBTphobia in Brazil.
