Esta pesquisa se dedica ao estudo do Protocolo para Julgamento com Perspectiva de Gênero, uma política judiciária lançada pelo Conselho Nacional de Justiça em 2021 com o propósito de avançar na luta contra a desigualdade de gênero no sistema judiciário. O estudo examina a origem, o propósito e a aplicação do Protocolo em recentes decisões judiciais disponibilizadas pelo CNJ até 30.01.2023 (data de conclusão da dissertação). Também foram estudadas iniciativas de reescrita de decisões judiciais sob perspectivas feministas que, acredita-se, será o resultado da aplicação do Protocolo. A análise das decisões reescritas destaca a importância de considerar perspectivas históricas, sociológicas e interseccionais para que a prestação jurisdicional promova a equidade de gênero e justiça social no âmbito jurídico. Foram analisadas as decisões judiciais de diversos ramos do direito que já aplicaram o método estabelecido no Protocolo e conclui-se que o resultado representa avanços significativos na promoção da igualdade de gênero no sistema judiciário, contribuindo para a construção de um ambiente mais inclusivo e equitativo para todas as pessoas, independentemente de seu gênero, raça ou origem. Destaca-se a importância de monitorar a eficácia do Protocolo para Julgamento com Perspectiva de Gênero, a fim de medir sua aplicação e evolução na qualidade das decisões judiciais. O acompanhamento contínuo da implementação do Protocolo é essencial para avaliar o seu impacto na promoção da igualdade de gênero e na garantia de um sistema judiciário mais justo e inclusivo.

This study is dedicated to investigating the Gender Perspective Judging Protocol, a judicial policy introduced by the National Council of Justice in 2021 with the aim of advancing the struggle against gender inequality within the judicial system. It scrutinizes the origin, purpose, and application of the Protocol in recent judicial decisions disseminated by the CNJ up to January 30, 2023 (the dissertation's completion date). Additionally, it explores initiatives regarding the rewriting of judicial decisions from feminist perspectives, which are anticipated outcomes of the Protocol's implementation. The analysis of these rewritten decisions underscores the significance of incorporating historical, sociological, and intersectional perspectives to ensure that judicial adjudication fosters gender equity and social justice within the legal domain. Judicial decisions from various branches of law that have already embraced the methodology outlined in the Protocol were examined, leading to the conclusion that the outcomes signify notable advancements in promoting gender equality within the judicial system. This, in turn, contributes to forging a more inclusive and equitable environment for all individuals, regardless of gender, race, or origin. Emphasis is placed on the importance of monitoring the efficacy of the Gender Perspective Judging Protocol to gauge its application and its impact on the quality of judicial decisions. Continuous monitoring of the Protocol's implementation is deemed essential for evaluating its effectiveness in promoting gender equality and ensuring a fairer and more inclusive judicial system.
