Com a instituição da Política de Recursos Hídricos, o Brasil procura criar uma série de instrumentos para orientar a forma de implementação da Política e organismos de gerenciamento em que preconiza uma gestão das águas descentralizada, integrada e participativa entre o Poder Público e a sociedade civil. Sendo assim, o presente trabalho contém uma análise dos elementos que compõem a Política de Recursos Hídricos com ênfase no papel dos Comitês de Bacias Hidrográficas. Portanto esta análise se justifica pela preocupação atual com a implementação coerente dessa Política, bem como com a ausência de integração entre o Poder Público e a sociedade civil no momento da execução da Política, cogitada dentro desses organismos (Comitê de Bacias). Sendo assim, foram realizadas pesquisas sobre a experiência estrangeira de gestão das águas, e também os instrumentos da Política Nacional de Meio Ambiente e de Recursos Hídricos, a instituição, composição e funcionamento dos Comitês de Bacias, além da apresentação do caso do Comitê Tietê-Jacaré, que embasaram a discussão para essa análise. Por fim, conclui-se que é importante considerar, para a transparência e legitimidade da Política de Recursos Hídricos, as características de cada instrumento de gestão, as relações entre si, a participação da sociedade civil nos processos decisórios e executivos da gestão, a adequação entre os entes federativos, que têm competência para legislar e a unidade de gerenciamento das águas, com vistas a diminuir as dificuldades de participação dentro do Comitê e, conseqüentemente, de adoção das decisões pelos representantes, em especial, municipais

With the instítution of the Water Resource Policy, Brazil has attempted to create a series of guidelines for the implementation of the Policy, as well as management bodies to preconize a decentralized, integrated and participative form of water management by the govenment authorities and civil society. This study, therefore, contains an analysis of the elements that make up the Water Resource Policy, with emphasís of the role of the Watershed Committees. This analysis is justified by current concerns about the coherent implementation of this Policy, as well as by the lack of integratíon between the authorities and society at the time the Policy was enforced, since this integration is essential within these agencies (the Watershed Committees). Research work was carried out on other countries' experience of water management, as well as on the instruments of the National Policy for the Environment and Water Resources and the instítution, compositíon and workings offhe Watershed Commíttees, in addition to a presentation of the Tietê-Jacaré Committee case upon which the discussion for this analysis was based. It was concluded that, for the Water Resource Policy to be clear and clothed in legitimacy, a variety of factors must be considered, including the characteristics of each management tool and its relation to the others, socíety's partícipation in the decísion- making and executive processes of this management, integration between the federal legislative bodies and the water management agency in order to reduce the difficulties involved in participation in the Commíttees and, thus, in their representatives decision-making, particularly that of municipal agents.
