As políticas de ativação para o trabalho consistem em uma tendência verificada no curso das transformações do Estado social em direção à conformação de modelos de proteção social de orientação neoliberal. Sua concretização se dá por intermédio de políticas sociais que tensionam de alguma forma seus beneficiários a que trabalhem ou, pelo menos, busquem trabalho e se qualifiquem para tanto. Trata-se de uma tendência de conformação dos direitos sociais que redimensiona o papel da assistência social em relação aos direitos trabalhista e previdenciário no interior dos seus sistemas de proteção. Interpretando este fenômeno com os aportes teórico- metodológicos da crítica da forma jurídica, constata-se que este tipo de medida expressa as determinações da nova organização da produção capitalista que se desenvolve com a reestruturação produtiva a partir dos anos 1970. Tal política social encontra suas determinações na forma jurídica, portanto opera suas funcionalidades pelo sujeito de direito e pela ideologia jurídica, promovendo a gestão e a reprodução da superpopulação relativa e revigorando o pacto social entre capital e trabalho. Na América Latina, para além disso, as políticas de ativação regulam a proporção da superpopulação relativa estagnada e fazem avançar o processo de abstração qualificada da força de trabalho para os novos padrões de produção.

The active labour market policies are a trend seen in the course of the transformations of the Welfare State towards the conformation of neoliberal-oriented social protection models. Its implementation takes place through social policies that somehow pressure its beneficiaries to work or, at least, look for work and qualify themselves for it. This is a trend towards the conformation of social rights that re-dimensions the role of social assistance in relation to labor and social security rights within their protection systems. By understanding this phenomenon with the theoretical-methodological contributions of the critique of the legal form, it can be seen that this type of measure expresses the determinations of the new organization of capitalist production that occurred with the productive restructuring from the 1970s. This social policy finds its determinations in the legal form, thus it operates its functionalities through subject of law and legal ideology, promoting the management and reproduction of relative overpopulation and reinvigorating the social pact between capital and labor. In Latin America, furthermore, activation policies regulate the proportion of stagnant relative overpopulation and advance the process of qualified abstraction of the workforce towards new production standards.
