O presente trabalho aborda o processo de mudança jurídico-regulatória sofrida pelo mercado de gás natural no Brasil, destacando o crescimento do mercado de distribuição a granel de gás, por meio dos modais: gás natural comprimido GNC e gás natural liquefeito GNL. A partir da constatação do conflito de competência surgido entre a Agência Nacional do Petróleo, Gás Natural e Biocombustíveis (ANP) e as Agências Estaduais de Regulação (representados nesse trabalho pelas disposições regulatórias da Comissão Estadual de Serviços Públicos do Estado de São Paulo CSPE), em matéria de distribuição a granel, procura-se analisar a estrutura regulatória e os modelos contratuais respectivos depreendidos da postura adotada por cada um dos entes reguladores desse mercado. Realizada a análise, busca-se, a título de conclusão, com base em parâmetros jurídicos, econômicos e sociais estabelecer qual das estruturas e modelos contratuais deve prevalecer na ordem jurídica nacional. The present work approaches the process of Judicial- Regulatory shakeup suffered by the market of natural gas in the Brazil, by highlighting the growth of the market of distribution in bulk of gas , for half a from the mode : natural gas compressed GNC & natural gas liquified GNL. From the certify of the conflict of ability appear between the Agência Nacional de Petróleo, Gás Natural e Biocombustíveis (ANP) & the States agencies of Regulation (represented in that work by regulatory dispositions from the Comissão Estadual de Serviços Públicos do Estado de São Paulo CSPE) in matter of distribution in bulk, is looked to analyze the structure and the inferred respective contractual models of the adopted position per item of the regulating beings of this market. Carried through the analysis, one searches, the conclusion heading, with base in legal, economic and social parameters to establish which of contractual structures and models must take advantage in national judicial order.
